Terms of Service

1. Who we are, and agreement to these terms

MortgageData AI (the “Service”) is operated by Polygon Research, Inc., a Delaware corporation with offices in Washington, DC (“Polygon Research,” “we,” “us”). These Terms of Service (the “Terms”) govern your use of the websites and services at mortgagedata.ai, app.mortgagedata.ai, and api.mortgagedata.ai. By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

The Service provides analytics, reports, and AI-assisted answers over U.S. mortgage-market data, including data derived from public and government sources. Some features are available without an account or charge; others require a registered account or a paid subscription. We may change, add, or remove features of the Service, and free-tier limits, at any time.

3. Eligibility and accounts

  • You must be at least 18 years old and able to form a binding contract to use the Service.
  • Registered accounts are created through our identity provider. You are responsible for safeguarding your credentials and for all activity under your account.
  • Paid subscriptions are licensed per individual user. Sharing one subscription across multiple people, or business-to-business uses such as consulting deliverables built on the Service, require our prior written agreement.

4. AI-generated answers and data — important disclaimers

The Service produces analytical outputs, including answers generated with the assistance of artificial intelligence, from datasets that originate with third parties (including government agencies). You agree that:

  • Outputs are provided for informational purposes only. They are not financial, investment, legal, tax, or professional advice, and are not a substitute for your own judgment or professional counsel.
  • AI-generated answers may contain errors, omissions, or out-of-date information. Underlying public datasets are published, revised, and corrected by their originating agencies on their own schedules.
  • You are responsible for independently verifying any output before relying on it in a business, lending, compliance, or investment decision.
  • We do not warrant the accuracy, completeness, or timeliness of any dataset or output.

5. Acceptable use

You agree not to:

  • Sell, resell, rent, or transfer your account or subscription.
  • Use the Service to advertise or offer to sell third-party goods or services.
  • Integrate the Service into an automated workflow, or access it by automated means outside interfaces we document for that purpose, without our prior written permission.
  • Scrape, bulk-download, or systematically extract data from the Service, or redistribute or resell datasets or substantial extracts of them, except as expressly permitted by your plan.
  • Reverse engineer, decompile, or attempt to derive the source code of the Service.
  • Circumvent usage limits, metering, authentication, or security controls.
  • Use the Service in violation of applicable law, including fair-lending and privacy laws.

We may suspend or throttle access that we reasonably believe violates this section.

6. Subscriptions, fees, and payment

  • Paid plans are billed through our payment processor on a recurring basis in U.S. dollars, at the prices and intervals presented at purchase.
  • Subscriptions renew automatically until cancelled. You may cancel by contacting customer service.
  • Fees are exclusive of taxes; you are responsible for applicable sales and use taxes.

7. Your content and feedback

You retain your rights in content you submit to the Service (such as questions you ask). You grant us a license to process that content to operate, secure, and improve the Service. If you send us feedback or suggestions, we may use them without obligation to you.

8. Intellectual property

The Service, including its software, design, models, compiled datasets, and documentation, is owned by Polygon Research or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service according to these Terms and your plan. No other rights are granted.

9. Third-party services

The Service depends on third-party providers — including identity, payments, hosting, and AI model providers — whose services are governed by their own terms. We are not responsible for third-party services we do not control.

10. Termination and suspension

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, for non-payment, or where required by law. On termination, your right to use the Service ends; sections that by their nature should survive (including disclaimers, liability limits, and dispute resolution) survive.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYGON RESEARCH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU HAVE PAID NOTHING, ONE HUNDRED U.S. DOLLARS).

13. Indemnification

You will defend and indemnify Polygon Research against third-party claims arising from your content, your use of the Service in violation of these Terms, or your violation of law.

14. Dispute resolution

Before filing a claim, both parties agree to attempt informal resolution for sixty (60) days after written notice. Disputes not resolved informally will be settled by binding arbitration in the District of Columbia, on an individual basis. Either party may bring qualifying claims in small-claims court or seek injunctive relief for intellectual-property misuse. Claims must be brought within one (1) year of accrual.

15. Governing law

These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-laws rules.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms at this page with a new “Last updated” date and, for material changes, provide reasonable additional notice. Continued use of the Service after changes take effect constitutes acceptance.
